Recently, I received a question from a concerned Tuscumbia resident about his rooftop antenna install and a persnickety Homeowner Association Board. Here is the question:
“For the past year, I have been using a rooftop antenna to receive local programming. The Federal Communications Commission, known on the streets as the FCC, has rules in place to protect homeowner’s rights to erect a rooftop antenna on their private structure, superseding any restrictions that a Homeowner Association Board may have placed in their bylaws. While there are some exceptions, such as if a central antenna is available for all residents to use then individual antennas may be banned, the exceptions are small and usually do not apply to the majority of residents wanting to install their own antenna. A complete list of circumstances and examples of what is protected by the FCC’s ruling can be found on their website, but in a nutshell, a Homeowner Association Board cannot place restrictions on ones’ ability to erect a rooftop antenna. However, sometimes the hassle of the fight far outweighs the sweetness of victory. If you want to continue to receive free programming and make the Board happy, you could look into installing an attic antenna. Similar to a rooftop antenna, it will continue to provide you with free television, but will be hidden from view. But to answer your question, the law is on your side and you have a right to install whichever antenna works best for you!
